Terms of Service

Please read these Terms of Service ("Terms") carefully before using the mybillbook service ("mb", "Service"). These Terms govern your use of the Service. By creating an account or otherwise using mb, you agree to be bound by these Terms.

1. Operator

The Service is operated by mybillbook (operated by Vikas Swaminathan, sole proprietor) ("we", "us", "our"). Our registered place of business is Bengaluru, Karnataka, India.

2. Eligibility & accounts

You must be at least 18 years old and competent to enter into a contract under Indian law. You agree to provide accurate, current, and complete information during sign-up and to keep that information accurate. You are responsible for safeguarding your password and for any activity under your account.

You retain all rights to data you create or upload (invoices, customer records, purchase bills, GSTR-2B JSON, etc.). You grant us a limited licence to host, transmit, and process that data solely to provide the Service.

We will not access your data except (a) for support and troubleshooting when you ask us to, (b) as required by law, or (c) for anonymised aggregate analytics that cannot identify any individual or tenant.

7. Tax compliance disclaimer

mb is a software tool. It is not a substitute for professional advice from a chartered accountant or tax practitioner. We make every effort to keep tax calculations and report formats current with CBIC publications, but we do not guarantee accuracy and accept no liability for incorrect filings. Always have a CA review your returns before filing.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service, whether in contract, tort, or otherwise, is limited to the fees you paid us in the 12 months preceding the claim. Since the Service is currently free, this means our beta-period liability is limited to INR 100.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data, even if advised of their possibility.

9. Termination

Either party may terminate this agreement at any time. We may suspend or terminate accounts that violate Section 4 (Acceptable use). On termination, you may export your data for 30 days; after that we will delete it, except where retention is mandated by law (see Section 11).

10. Changes to these Terms

We may revise these Terms from time to time. Material changes will be announced via email to your registered address and via an in-app banner at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

11. Governing law & retention

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.

Notwithstanding any termination, we will retain books and records you have generated through the Service (invoices, credit notes, payment records) for 6 years from the end of the relevant financial year, as required by the CGST Rules. We will not use this data for any purpose other than producing it on demand to the appropriate authority or to you.
